Bring Your Own Venue (BYOV) Application Agreement

Fringe Theatre Adventures (FTA) is the producer of the Edmonton International Fringe Theatre Festival.

The Applicant guarantees sole responsibility for all costs related to the production and promotion of their venue and related performances.

APPLICATION

  1. The Applicant shall submit an application fee in the amount of $500 plus 5% GST ($525) with the completed application agreement.
  2. The Applicant may withdraw the application at any time. Application refunds will be issued within the following parameters;
    1. Up to and including May 31, 2012 the applicant will receive a full refund minus an administration fee of $30 plus 5% GST.
    2. Up to and including June 30, 2012 minus a charge of $230 plus 5% GST.
    3. After June 30, 2012 - the Applicant will receive no refund.

BY SUBMITTING THIS APPLICATION IT IS AGREED THAT:

APPLICANT’S VENUE

The Applicant shall be responsible for all costs, damages or claims directly related to the production, communication, marketing and promotion of their performances including, but not limited to;

  1. The procuring and payment of rental agreements, insurance and liability coverage for the performance venue. The venue must meet safety, occupancy and fire-code regulations, as outlined by the City of Edmonton, the Province of Alberta, and the Government of Canada. The City of Edmonton Fire Marshal must be permitted to inspect your venue.
  2. The procuring and payment all expenses related to costumes, props and set pieces, actor(s), director, stage manager, front of house staff, technicians, lighting and sound design, stage, masking, seating risers and chairs and any related equipment.
  3. The Applicant determines the performance schedule, time and duration of their presentation within the start and closing times of the festival as set by FTA. The FTA lottery venue schedule will not be altered to accommodate the Applicant's scheduling.
  4. The Applicant is obligated to adhere strictly to the performance schedule, time and duration as submitted by the Applicant for festival program guide, and will be held accountable for any financial losses resulting from any deviation of the pre-determined schedule.

MARKETING AND PUBLICITY

  1. FTA will include a listing of the Applicant’s production and related performance information in the festival program guide.
  2. FTA will provide venue signage consistent with all festival venues.
  3. FTA is responsible for general advertising of the festival and the related marketing and box office expenses.
  4. FTA may provide an opportunity for the Applicant to be involved in publicity to promote the festival and/or the Applicant’s production. Participation in such publicity opportunities is at the sole discretion of the Applicant.

BOX OFFICE

FTA is pleased to provide online, phone and in-person box office ticketing services to the Applicant within the following conditions:

  1. FTA shall provide ticketing services for the Applicant’s performances and all festival ticket revenue shall be collected through the FTA box office.
  2. FTA will sell 100% of the Applicant’s ticket inventory in advance through the FTA box office.
  3. The Applicant is permitted to define two (2) ticket prices that include GST. The top ticket price may not exceed $12, including GST. The Applicant must sell the tickets at the door for the pre-determined price set out in the festival program guide.
  4. FTA agrees to pay the Applicant one hundred percent (100%) of gross box office receipts, based on the ticket prices as defined by the Applicant, less GST and any applicable withholding taxes.
    Please note:
    FTA is obligated and accepts responsibility for remitting any taxes, including GST, to the Receiver General of Canada.
  5. FTA shall payout the Applicant’s ticket settlement at appointed times set by FTA. Payment will be made by cheque only. The Applicant will be notified when and where they can pick up the settlement cheque.
  6. The Applicant may, at their discretion, designate up to 5% of their ticket inventory as complimentary tickets to their performances. The Applicant will provide the list of complimentary ticket names to artist services no later than 5 PM the day prior to each performance.
  7. FTA will apply a capital replacement fee to each ticket sold. This fee, paid by the patron, will help to offset a portion of the festival’s operating costs.
  8. FTA may reasonably designate complimentary tickets to the Applicant’s performances for use by festival volunteers, staff, media, funders, sponsors and industry peers.
  9. Performance venues, whenever possible, will include wheelchair seating. These stalls are included in the total ticket inventory and will only be sold to wheelchair patrons. This inventory will NOT be released for sale to able-bodied patrons.
  10. If the Applicant desires to sell unsold tickets at the door of the Applicant’s venue, it is the responsibility of the Applicant to obtain the supply of tickets from artist services the day of the performance. The Applicant must submit a request by 5 PM the day before the performance indicating the quantity of unsold tickets they would like to receive to sell at the door of the Applicant’s venue. 
  11. Festival Passes and “Fringe Bucks” may not be redeemed at the door of Applicant’s venue but may be used in advance to obtain tickets to Applicant performances.
  12. The Applicant is responsible for the remittance of any taxes related to the Applicant’s door sales to the Receiver General of Canada.
  13. The Applicant will comply with FTA’s established “latecomer” policy.

RESPONSIBILITIES OF THE APPLICANT

  1. The Applicant guarantees that all applicable contracts and contractual obligations that may be required by professional associations, unions and holders of copyrights for the performances have been duly adhered to and are in place as required. All payments required under such contracts will be made by, and are the sole responsibility of, the Applicant.
  2. The Applicant assumes sole responsibility for any and all contractual obligations related to the production under this application, and for ensuring that the artistic content of the production abides by the laws of Alberta and Canada.  The Applicant holds FTA blameless and accepts full liability for any claims arising from these responsibilities.
