Fringe Theatre

Fringe Theatre (referred to in this Privacy Policy as “Fringe,” “we,” “us,” and “our”) is a registered non-profit and charity located at 10330 84 Ave Edmonton, AB, Canada T6E 2G9. We are an organization that cultivates ongoing collisions between community and art all year long.

This document informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data.

Services

Fringe offers multiple services to meet our community’s needs, including this website, ticketing services, an online store, cafe, rental spaces, and more (the “Services”). See below to determine the specifics of each service we offer. Those who engage with our Services through purchases, donations, attendance, online interaction, etc., are each a “Patron” (and collectively referred to as “Patrons,” “you,” and “your”).

Service Providers

We may employ third party companies and individuals to facilitate our Services (“Service Providers”), provide the Services on our behalf, provide tangential services or assist us in analysing how our Services are used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Sites

Fringe hosts many of our Services online at multiple websites and domains, including fringetheatre.ca, tickets.fringetheatre.ca, shop.fringetheatre.ca, cafe.fringetheatre.ca, learn.fringetheatre.ca, and tv.fringetheatre.ca (the “Sites”).

Collection of Personal Data

When you use our Services online or in person, we may collect data that can be associated with you and/or used to identify you (“Personal Data”). The Personal Data we collect varies depending on the Services provided. See the Services below to read more about how we collect your data on each Service.

Collection of Non-Personal Data

When using our Services online, we collect some information that is automatically sent to us from the device through which you access the Services. This data is non-identifying and as such is considered “Non-Personal Data.” This Non-Personal data includes, but is not limited to, your IP address and which browser you’re accessing the services on.

The Services also use browser cookies that can identify your browser each time you visit our Sites. These cookies provide us information, such as which pages you visited and how many Patrons are browsing our Sites. This helps Fringe understand Patron interests and improve the experience of visitors to our Sites. The cookies can also determine your device, so that your preferences can be saved for future uses of our Services. You can manage your cookie preferences within your browser. Check with your browser provider for information and instructions.

How We Use Your Data

Regardless of Service, the Personal Data we collect using our Services may be used as follows:

Internal Business Purposes

We may use your Personal Data for internal business purposes, including but not limited to, providing Patron support, performing a contract with you, improving the functionality of the Services, investigating account or Patron issues, and Patron account management.

Marketing & Solicitation

Fringe may use your Personal Data collected via the Services to contact you via email or physical mail to solicit donations to Fringe. To opt-out of physical mail marketing, contact hello@fringetheatre.ca. For email marketing, contact hello@fringetheatre.ca or unsubscribe using the link provided in the marketing email. Fringe will not use your Personal Data to solicit other types of purchases without your consent.

Fringe uses remarketing services to advertise on third party websites to you after you visited our Services. We and our third-party vendors use cookies to inform, optimise and serve ads based on your past visits to our Services. These vendors include, but are not limited to,

  • Google Adwords
  • Bing Ads Remarketing
  • Meta

Payments

We may provide paid products and/or services within the Services. In that case, we use third-party services for payment processing (the “Payment Processors”). We will not store your payment card details. That information is provided directly to our third-party Payment Processors whose use of your Personal Data is governed by their Privacy Policy. These Payment Processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Research

The data you provide to Fringe helps us understand and serve our audiences better. Our research uses your Personal Data and aggregates the data to create aggregated Non-Personal Data. Research done with this aggregated data is non-identifying and not affiliated with you or your accounts.

Fringe works with third-party vendors (Google Analytics) that use cookies to help us with research and analytics on Patrons using our Sites.

Services

Broadcasting Services

Service Details

Fringe’s Services include online digital broadcasting services for hosting and streaming digital video content (our “Broadcasting Services”), hosted on Fringe’s website, tv.fringetheatre.ca (our “Broadcasting Site”).

Collection of Personal Data

The Personal Data we collect when using our Broadcasting Services is optional and dependent on desired available features:

Account

You may create an optional account on our Broadcasting Services. An account may give you access to otherwise restricted content or features, such as commenting on content. Account creation requires your email.

Comments

Commenting on content within our Broadcasting Services where comments are enabled requires an account.

Email Gates

Some content may be restricted and require submission of an email and consent for contact.

How We Use Your Personal Data

The Personal Data we collect using our Broadcasting Services may additionally be used as follows:

Automatic Communications

We will use your email to deliver automatic customer service emails, such as account creation and password reset emails. These result from your interaction with the Broadcasting Services and always occur regardless of your communication preferences.

Access and Use

Personal Data provided to access and use our Broadcasting Services, such as your email when creating an optional account, can be used to further access our Broadcasting Services. An account is not required to use these services.

Storage of Personal Data

Personal Data is stored by third parties to whom we have transferred the data. Worldplay (Canada) Inc. (https://www.worldplaynetworks.com/) stores data from your interactions on our Broadcasting Services. Data is stored in accordance with this Privacy Policy.

Cafe and Shop Services

Service Details

Fringe’s Services include food and beverage services (the “Fringe Grounds Cafe” or “Cafe”) and retail services (the “Shop”).

Fringe’s Cafe and Shop websites and domains, cafe.fringetheatre.ca (our “Cafe Site”) and shop.fringetheatre.ca (our “Shop Site”), and in-person Cafe and Shop locations, are collectively referred to as the “Cafe and Shop Services.”

The Personal Data we collect when using our Cafe and Shop Services varies depending on how the Services are provided:

All Patrons

If you make a purchase, we may collect financial information from you, such as credit card number, to facilitate transactions. We do not collect financial information from you if you pay with cash.

Patrons Online and by Phone

Personal Data collected online and by phone typically includes, but is not limited to, name and email. All other information provided by you, including physical address, is voluntary. Some types of purchases, such as deliveries, require more Personal Data to fulfill the order.

Patrons in Person

Patrons using our Cafe and Store Services in person will not be required to submit Personal Data.

Changes in Requested Personal Data

We may request and require more Personal Data depending on changing requirements to offer the Cafe and Shop Services safely, such as requesting both an email address and phone number. These changes may be required by law, public health policy, or by Fringe.

How We Use Your Personal Data

The Personal Data we collect using our Cafe and Store Services may additionally be used as follows:

Order and Service Fulfillment

Personal Data provided for fulfilling orders and services will be used to do so. For example, if you place a pre-order for a sandwich, we will use the Personal Data you provide to confirm your order.

Automatic Communications

We will use your email to deliver automatic transaction emails, including order confirmations and order status update emails. These result from your interaction with the Cafe and Shop Services and always occur regardless of your communication preferences, since they are required to fulfill your order.

Automatic SMS messages may also be used to notify you of your order status.

Access and Use

Personal Data provided to access and use our Cafe and Shop Services online, such as your email when creating an optional account, can be used to further access our Cafe and Shop Services. An account is not required to use these services.

Storage of Personal Data

Personal Data is stored by third parties to whom we have transferred the data. Square, Inc. (https://squareup.com/ca/) stores data from your interactions on our Cafe and Store Services, but this data may be transferred to other third-party services we utilize, such as our donation management system if you donate through our Cafe and Shop Services. Data is stored in accordance with this Privacy Policy.

Donation Services

Service Details

As a charitable organization, Fringe collects donations to continue our mission. These donations are collected in-person and online through third-party donation processors, Benevity (https://benevity.com/), CanadaHelps (https://www.canadahelps.org/), Neon CRM (https://neonone.com/), our Ticketing Services, and our Cafe and Shop Services.

Collection of Personal Data

The Personal Data we collect when using our Donation Services depends on the Payment Processor, but all collect similar information:

All Patrons

If you donate, we may collect financial information from you, such as credit card number, to facilitate transactions. We do not collect financial information from you if you donate with cash.

We will request Personal Data required to issue official donation receipts when applicable, including your full name and address.

Patrons Online and by Phone

Personal Data collected online and by phone typically includes, but is not limited to, name and email. All other information provided by you, including physical address, is voluntary.

Patrons in Person

In-person cash or cheque donations do not require any Personal Data, but we may request Personal Data to ensure the processing of the donation.

How We Use Your Personal Data

The Personal Data we collect using our Donation Services may additionally be used as follows:

Automatic Communications

We will use your email to deliver automatic donation appreciation emails and transaction confirmation emails. These result from your interaction with the Donation Services and always occur regardless of your communication preferences.

Access and Use

Personal Data provided to access and use our Donation Services, such as your email when creating an optional account, can be used to further access our Donation Services. An account is not required to use these services.

Donation Receipts

We may use your Personal Data to issue official donation receipts.

Storage of Personal Data

Personal Data is stored by the third parties to whom we have transferred the data. Data is stored in accordance with this Privacy Policy.

Rental Services

Service Details

Fringe’s Services include venue rental and event services (the “Rental Services”).

Collection of Personal Data

The Personal Data we collect when using our Rental Services includes but is not limited to:

  • Your full name
  • Your contact information, including email and phone number
  • Your address, if applicable
  • Your billing information
  • Your GST number, if applicable

How We Use Your Personal Data

The Personal Data we collect using our Rental Services is used to create contracts, invoices, estimates, and manage your rentals with Fringe.

Storage of Personal Data

Personal Data is stored by our third party, Infor (https://www.infor.com/), to whom we have transferred the data. Data is stored in accordance with this Privacy Policy.

Ticketing Services

Service Details

Fringe provides services to artists, producers, organizers, and creators (collectively referred to as “Producers”) to promote and sell tickets, reservations, subscriptions, merchandise, donations, and give access to shows, conferences, and activities (each, an “Event”) to Patrons on behalf of Fringe Theatre and on behalf of Producers.

Fringe’s ticketing website and domain, tickets.fringetheatre.ca, (our “Ticketing Site”) and the ticketing services available on the Ticketing Site, in person at our physical box office locations, and in person at third-party Events using our ticketing services, are collectively referred to as the “Ticketing Services.”

Collection of Personal Data

The Personal Data we collect when using our Ticketing Services varies depending on how the Ticketing Services are provided:

All Patrons

If you make a purchase, we may collect financial information from you, such as credit card number, to facilitate transactions. We do not collect financial information from you if you pay with cash or for $0 transactions.

We may request accessibility information from you, such as reduced mobility, vision impairments, or service animal requirements, to accommodate your accessibility needs at the Events.

Patrons Online and by Phone

Personal Data collected online and by phone typically includes, but is not limited to, name and email. All other information provided by you, including physical address, is voluntary.

Patrons in Person

For Patrons using the Ticketing Services in person, Fringe may request your name and postal code. This identifies you within our Ticketing Services to prevent duplicate Patron accounts or transactions within the wrong Patron account. Any other information provided by you in person is voluntary.

Patrons using our Ticketing Services in person may refuse to provide Personal Data, but such refusal may prevent use of our Ticketing Services when the Personal Data is required to fulfill the requested Ticketing Service (such as an email for e-tickets).

Changes in Requested Personal Data

We may request and require more Personal Data depending on changing requirements to offer Events safely, such as requesting both an email address and phone number. These changes may be required by law, public health policy, by Fringe, or by the Producer.

How We Use Your Personal Data

The Personal Data we collect using our Ticketing Services may additionally be used as follows:

Service Fulfillment

Personal Data provided for fulfilling Ticketing Services will be used to do so. For example, if you purchase an e-ticket, we will use the Personal Data you provide to email the ticket to you. We may also share your name with a Producer to check-in Patrons at Events.

Automatic Communications

We will use your email to deliver automatic electronic ticket emails, order confirmation emails, Event update emails, and Event reminder emails. These result from your interaction with the Ticketing Services and always occur regardless of your communication preferences, since they are required to fulfill your order.

Access and Use

Personal Data provided to access and use our Ticketing Services, such as your email when creating an account, will be used to further access and use our Ticketing Services. For example, Personal Data provided to create an account can be used again to access and use our Services under that account profile.

Accessibility Information

We may share your accessibility information with Producers to accommodate your accessibility needs. This information is limited to your name, number of tickets for an Event, and the accessibility information you provide.

Producer Communications

You may also receive communications from Producers where such communications are required to fulfill services. For example, if you donate to a Producer that requires a charitable tax receipt, the Producer will contact you. Specifically, such Producers may contact you via email or SMS message: (a) directly; (b) indirectly through Fringe’s email address (boxoffice@fringetheatre.ca); or (c) indirectly through an external service provider.

Please note that Fringe does not determine the content of these Producer-initiated communications. However, Producers are required to comply with all applicable laws when sending such communications. Producers also agree that they are not to send further communications beyond what is required to fulfill orders.

Disclosure of Personal Data to Producers

Producers may receive your Personal Data when such information is required to fulfill your use of the Ticketing Services. For example, if you purchase a ticket for an Event outside of the Fringe Theatre Arts Barns, the Producer may be provided with your name and purchase information to allow you access to the Event. Producers who receive Personal Data agree that the Personal Data shared with them will be limited in use to fulfill the Ticketing Services. When transferring personal information to a third party, Fringe will ensure (through a contractual obligation or otherwise) that the third party will put protections in place that comparable to, or better than, our own protections.

Producers may receive your contact information should you explicitly consent to contact from the Producer while using the Ticketing Services. This is limited to your name and email address.

Storage of Personal Data

Personal Data is stored by third parties to whom we have transferred the data. Red Sixty One Limited (https://www.red61.com/) stores data from your interaction on our Ticketing Services, but this data may be transferred to other third-party services we utilize, such as our donation management system. Data is stored in accordance with this Privacy Policy.

Disclosure and Transfer of Personal Data

Legal Requirements

We will disclose your Personal Data without your knowledge or consent where the law requires or permits us to do so.

No Sale

We will not sell your Personal Data to third parties. We may disclose, transfer or share aggregated Non-Personal Data with certain third parties without further notice to you.

Transfer of Data

Your information, including Personal Data, may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside Canada and choose to provide information to us, please note that we transfer the data, including Personal Data, to Canada and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Fringe will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

Accessing, Updating, or Deleting Your Personal Data

You can request access to some of your Personal Data being stored by us by emailing hello@fringetheatre.ca. You can also ask us to correct, update or delete any inaccurate Personal Data that we process. Full account and Personal Data deletion can be requested by emailing hello@fringetheatre.ca, but please note that deletion will prevent you from accessing previous transaction and account information in our Services.

If you are a registered Patron in any of our Services, you can update your Personal Data by logging in to the Services and updating your account details.

How Long We Retain Your Personal Data
Fringe will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

Limiting Your Personal Data

Browsing our Services does not require you to submit any Personal Data beyond the Automatic Data that is collected. However, to make purchases online you must provide your name and email. Purchases with monetary value will require address details for credit card verification.

Security of Data

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Links to Other Sites

Our Services may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time as our Services change. You are advised to review this Privacy Policy periodically for any changes.
